Description

This online training (e-learning) will enable you to learn about landmark judgments handed down by specialized tribunals (Commission de la fonction publique, Commission d'accès à l'information, Tribunal administratif du travail and arbitration tribunals) and the courts on the subject of psychological harassment in the workplace and related issues.

The case law interpretation of the relevant sections of the Act respecting labour standards (notably 81.18 and 81.19) will be analyzed. In particular, we will look at the reasons for decisions rejecting or upholding harassment complaints, and at certain developments concerning the notion of incivility. We will also report on decisions following the contestation of sanctions for incivility or harassment in the workplace, in particular sanctions taken against union officers. 

With regard to the external investigation of harassment complaints, we will examine a number of decisions in which inadequate investigative practices were found on the part of both investigators and employers. We will also take a look at decisions concerning access requests. Finally, recent case law on querulence will be presented.

  • Exploration of landmark decisions to dismiss or uphold harassment complaints and the reasons behind these rulings
  • Methodological comments on the proof and interpretation of alleged facts and their legal qualification
  • Analysis of case law on requests for access to investigation reports
  • Analysis of case law on incivility and quarrelsomeness
